Terms & Conditions

1. Eligibility

The Game is only available to participants aged 18 years or older. Bookings must be made by an individual on behalf of a team. That individual accepts responsibility for ensuring all team members comply with these Terms. Players must participate in the Game physically, on location, using their own internet-connected devices.

2. Nature of the Game

Questana is an outdoor scavenger hunt where clues, prompts, and messages are delivered via a custom web-based interface. Game routes, hints, and progression are generated automatically using large language models (LLMs). Game sessions last up to 3 hours from the start time. Access beyond this time will be restricted.

3. Communication & Technology

Questana uses a bespoke in-browser chat interface and real-time WebRTC-based communication tools to facilitate coordination among team members. These systems are provided as-is, and while we aim for high reliability, we do not guarantee uninterrupted service.

4. Data Collection & Use

We collect the following user information for the purposes of delivering the Game: name, email address, and chat messages exchanged during the session, together with device location data where needed to support gameplay and verify presence at quest locations. Chat data is stored for up to 4 years and may be used for functionality, monitoring, or improvement.

Users may request deletion of their data by contacting us with their game name, location, and booking email address.

5. Payments & Refunds

All bookings are payable in advance via Stripe. The individual booking is responsible for the full team payment. Refunds are offered upon request and must include a reason. Contact: refund@questana.ai

6. Intellectual Property

All content, routes, logic, and technologies used in the Game are the property of Questana Limited. Users may not reproduce or redistribute any part of the Game.

7. Player Responsibilities

You agree not to engage in illegal, unsafe, or disruptive behavior, and not to abuse the chat or AI systems.

8. Disclaimer of AI Accuracy

Game prompts are generated using LLMs and may not always be accurate. Players must use their own judgment.

9. Liability & Safety Disclaimer

Players are responsible for their own safety during gameplay. Questana Limited is not liable for injuries, damage, or loss during participation. Liability is limited to the booking fee.

10. Cancellation & Suspension

We reserve the right to cancel or suspend sessions and refuse access in cases of misuse or violations.

11. Prize Promotions and Winner Publicity

Questana may, from time to time, offer cash prizes, rewards, promotional competitions or other incentives in connection with its quests, games or promotional activities. Details of any applicable prize, eligibility requirements, promotional period, entry requirements, scoring method, winner selection process, tie-break rules and claim deadline may be set out in the relevant promotion, on the Questana website, in the Questana app or through the relevant promotional channel.

Eligibility and Winner Selection

To be eligible for a prize, participants must comply with these Terms and Conditions, the rules of the relevant quest or promotion, and any additional eligibility criteria communicated in connection with that prize.

Unless otherwise stated, winners will be selected in accordance with the criteria set out for the relevant prize or promotion. This may include, for example, achieving a qualifying score, completing a quest, sharing eligible content on social media, tagging Questana, participating in a promotional activity, or meeting any other requirements communicated in connection with that prize. All entries, submissions and results are subject to verification by Questana before a winner is confirmed.

Questana reserves the right to verify a participant's eligibility, score, game activity, identity, compliance with the applicable rules and any other information reasonably required before confirming or paying a prize.

Questana may disqualify a participant, withhold a prize, revoke a provisional winner announcement or select an alternative eligible winner where Questana reasonably believes that:

• the participant has breached these Terms and Conditions or any applicable promotion rules;
• the participant is not eligible to receive the prize;
• cheating, manipulation, fraud, collusion, use of multiple entries where prohibited, or other unfair conduct has occurred;
• a score, result or winner determination was affected by a technical error, system malfunction, administrative mistake or other material error; or
• the participant fails to provide information reasonably required to verify eligibility or arrange delivery of the prize.

Questana's decision regarding eligibility, verification, disqualification and the awarding of prizes is final, subject always to applicable law and participants' statutory rights.

Claiming and Receiving a Prize

A winner may be required to respond to Questana within the timeframe stated in the relevant promotion or winner notification, and to provide information reasonably necessary to verify eligibility and arrange payment or delivery of the prize.

Where a winner cannot be contacted, does not respond within 14 days of Questana's initial winner notification, or within any alternative timeframe stated in the relevant promotion or winner notification, fails verification, refuses the prize or is disqualified in accordance with these Terms and Conditions, Questana may award the prize to an alternative eligible winner.

Unless otherwise stated, prizes are non-transferable. Any tax liability or other personal obligation arising from the receipt of a prize is the responsibility of the winner, where applicable.

Changes, Suspension or Cancellation

Questana may amend, suspend, withdraw or cancel a prize or promotion where reasonably necessary due to circumstances outside its control, technical problems, fraud, misuse, error, legal or regulatory requirements, or where the promotion cannot be administered fairly or as originally intended.

Where practical, Questana will communicate any material change, suspension or cancellation through the website, app or promotional channel through which the relevant prize or promotion was advertised.

Nothing in this section limits or excludes any rights participants may have under applicable consumer law.

Winner Announcements and Publicity

By participating in a prize promotion, participants acknowledge that Questana may announce the outcome of the promotion and publish limited information about a confirmed winner where reasonably necessary to identify the winning result and promote the competition. This may include the winner's first name, team name, city or quest completed, score and prize won.

Questana will not publish a winner's full name, photograph, video, social media handle, testimonial, interview, likeness or other additional identifiable promotional content without first requesting the winner's separate permission, unless otherwise permitted or required by law.

A winner may be invited to participate in promotional activity relating to their prize, including social media posts, photographs, videos or testimonials. Participation in any such additional promotional activity is voluntary and is not a condition of receiving the prize.

Any personal data collected or used in connection with a prize, winner verification, payment, winner announcement or publicity will be handled in accordance with Questana's Privacy Policy and applicable data protection law.

12. Governing Law

These Terms are governed by Irish law. Disputes are subject to the jurisdiction of the Irish courts.
